A teenager, at the age of 14, Evan Miller along with another person took the life of Cole Cannon in 2003. Cannon, was killed due to his trailer home being set on fire shortly after he became awas the victim of a severe beatingsbeating with a baseball bat. As a result of a trial, Miller was charged with an act of murder in the course of the deliberate setting of a housethe on fire. His sentence claimed that he will serve a lifetime in prison, without the eligibility to apply for parole.
The judgment of the court is mainly based on the consolidation of two cases. In Jackson vs. Hobbs, Jackson was at the age of
fourteen14 when he and the otheranother two youthyouths went to a store in Arkansas planning to steal from it. The decision was reversed by the Supreme Court. The review of the above casescase was approved by the Supreme Court presenting the subject of the constitutionality of a life sentence without parole for fourteen-year-olds who committed crimes of murder crimes. The two cases follow two earlier cases before the Supreme Court. In the case of "Roper v. Simmons", it was held that the imposition of the death penalty on defendants below the age of eighteen18 violated the eighth amendment. In the case of "Graham v Florida", it was held that sentencing defendants below the age of eighteen18 to life without parole violated the eighth amendment. It was held that juveniles are less liable in light of manageability, vulnerability, and immaturity.
